Terms of Service

1. Acceptance of Terms

By accessing or using our website, mobile services, or APIs (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility and Account Registration

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use the Service. By registering, you confirm that all information you provide is accurate and current, and you agree to keep it up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

3. Nature of Our Service — We Are Not a Party to Your Transactions

click4ble.com operates an online classifieds platform that allows users to publish, browse, and respond to listings for goods, services, and job opportunities, and, where available, to complete payment for certain transactions through our integrated payment provider. We are a venue and technical intermediary only. We are not the seller, buyer, lessor, employer, or job applicant in any transaction conducted through the Service, and we are not a party to any contract of sale, service, or employment formed between users. Any such contract is formed solely between the users involved, who are solely responsible for negotiating, fulfilling, and resolving disputes arising from it.

4. Listing Guidelines and Content Responsibility

You are solely responsible for the content of any listing, message, image, or other material you submit to the Service ("User Content"). By publishing a listing, you represent and warrant that:

• you have the legal right to sell, lease, or offer the item, service, or position described;
• the listing accurately and truthfully describes the item, service, or position, including its condition, price, and any material defects;
• the listing, and the item or service it describes, complies with all applicable laws, including consumer protection, product safety, and intellectual property law; and
• you will honestly and lawfully complete any transaction you enter into with another user.

We prohibit listings that are fraudulent, deceptive, duplicated, counterfeit, or that involve stolen, illegal, hazardous, or otherwise regulated goods, as well as content that is unlawful, hateful, or sexually explicit. Every listing is automatically screened by our AI moderation system before publication for compliance with these guidelines, but this automated review checks for policy compliance only — it does not verify the truthfulness, legality, ownership, quality, or safety of any individual listing, and we do not guarantee that all non-compliant content will be detected before publication.

5. Content Moderation, Reporting, and Removal

If your listing does not pass our automated review, it is not published and you will be shown a reason; you may edit and resubmit it, or contact our support team to request a manual review. We may also remove, suspend, or restrict access to any listing or account, with or without prior notice, if we reasonably believe it violates these Terms, applicable law, or poses a risk to other users, and we will provide a reason where legally required to do so. If you encounter a listing or user you believe is fraudulent, illegal, or otherwise violates these Terms, please report it using the listing's "Report" option or our Contact Us page; we will review reports and take appropriate action.

6. Marketplace Status and Consumer Information

Most listings on click4ble.com are published by private individuals selling personal items, not by businesses acting in a professional capacity ("traders"). Where a seller is a private individual, statutory consumer protections that apply to purchases from traders, such as a right of withdrawal or a statutory guarantee of conformity, may not apply to your purchase. We encourage buyers to communicate directly with sellers about the condition, authenticity, and specifications of an item before completing a purchase. If you are listing an item or service as a business or in the course of a trade, profession, or craft, you are responsible for complying with any consumer-facing disclosure obligations that apply to you under applicable law, including identifying yourself as a trader.

7. Escrow, Payments, and Fees

Featured-listing upgrades (Extended and Premium tiers) are purchased directly from click4ble.com through Stripe Checkout. By purchasing a featured-listing upgrade, you expressly request that we begin performance immediately, and you acknowledge that you lose your statutory right of withdrawal once the upgrade is activated on your listing, in accordance with Article 16(m) of Directive 2011/83/EU.

Peer-to-peer purchases made through our "Buy Now" feature are processed via Stripe Connect: your payment is held in escrow and released to the seller once delivery is confirmed. Personal (individual) sellers pay no commission — the full sale price is released to a personal seller. Sales made through an approved business storefront are subject to a commission, deducted from the released amount, at the following category-based rates:

• Electronics and Computer Hardware: 4%
• Household, Garden, and Office: 4.5%
• Fashion: 5%

Every commission-bearing sale is subject to a minimum fee of €1.50, even where the percentage above would otherwise produce a lower amount. Where a business listing carries an active discount, commission is calculated on the discounted price actually paid by the buyer, not the item's original listed price.

The Jobs and Services categories are not sold through escrow and are not subject to the commission described above. Publishing a Jobs or Services listing is free of charge for an approved business account with the corresponding Employer or Service Provider feature enabled, and the listing stays live for 30 days; personal accounts may no longer publish new Jobs or Services listings. A business account may optionally pay a one-time 5 EUR fee to promote a Jobs or Services listing, which sorts it first within its category for the remainder of the listing's 30-day duration.

By using the "Buy Now" feature as a buyer, or by selling through an approved business storefront, you acknowledge and agree that your payment is processed through Stripe's escrow model as described in this section, including any applicable commission or promotion fee.

click4ble.com does not itself hold, control, or have access to your full card details — these are processed directly by Stripe. Peer-to-peer purchases are currently limited to buyers paying with a card issued within the EU, in compliance with applicable regional regulations. We are not a bank, escrow agent, or financial institution, and Stripe's own terms of service also apply to any payment you make or receive through the Service.

8. Job Listings and Applications

Employers and individuals may publish job listings, and users may submit CVs, cover letters, and job applications through the Service. We do not verify the accuracy of job listings, the identity or legitimacy of the poster, or the outcome of any hiring process, and we are not a party to any employment relationship formed as a result. When you apply for a listed position, your application materials are shared directly with the listing's poster; you should exercise the same caution you would with any other job application submitted outside our platform.

9. Intellectual Property

You retain ownership of the content you submit to the Service. By publishing content, you grant click4ble.com a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating and promoting the Service. The click4ble.com name, logo, and platform design are our property and may not be used without our prior written consent. If you believe content on the Service infringes your intellectual property rights, please contact us via the Contact Us page with details of the alleged infringement so we can investigate.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any listing, user, or item offered through the Service is accurate, genuine, safe, or lawful. Nothing in this section limits any warranty that cannot be excluded or limited under applicable law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, click4ble.com and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service, including any transaction, listing, or communication with another user, even if we have been advised of the possibility of such damages. We are not liable for any loss or damage caused by the content, conduct, or transactions of users, including fraudulent, inaccurate, or illegal listings, to the fullest extent permitted by law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable EU or Bulgarian law.

12. Indemnification

You agree to indemnify and hold click4ble.com and its officers, employees, and agents harmless from any claims, damages, losses, and expenses, including reasonable legal fees, arising from your use of the Service, the content of your listings or other User Content, your violation of these Terms, or your violation of any right of a third party, including through a transaction with another user. This obligation does not apply to the extent a claim results from our own violation of applicable law.

13. Termination and Rightful Termination for Cause

We reserve the right to suspend or terminate your access to the Service — including, for a business account, its storefront and all associated listings — with or without prior notice, if we reasonably believe that you have violated these Terms, provided false or misleading information, or engaged in fraudulent, abusive, deceptive, or unlawful conduct in connection with the Service ("Rightful Termination"). This includes, without limitation, publishing or attempting to sell stolen, counterfeit, or otherwise unlawfully obtained goods; repeated or serious breaches of the listing standards in Section 4; circumventing or attempting to circumvent our content moderation, identity, or payment-verification systems; or any conduct that we reasonably believe puts other users, click4ble.com, or the integrity of the Service at risk. This right applies equally to personal accounts and to business accounts, regardless of an account's VAT-verification or storefront-approval status.

Where reasonably practicable and not prohibited by applicable law — for example, where giving notice could facilitate ongoing unlawful activity or compromise a fraud investigation — we will provide you with the reason for a Rightful Termination. A Rightful Termination does not entitle you to a refund of any fees already paid for featured-listing upgrades, Jobs/Services promotion fees, or other purchases, except where a refund is required by applicable law.

Independently of any action we may take under this Section, you may stop using the Service and close your account at any time from your Account Settings; see our Privacy Policy for how your data is handled upon account closure.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Bulgaria and applicable European Union law, without regard to conflict-of-law principles. If you are a consumer resident in the EU, you also benefit from any mandatory consumer-protection provisions of the law of your country of residence, which take precedence over any conflicting provision of these Terms. Any dispute arising from these Terms or your use of the Service will first be addressed through our support ticket system. If you are an EU consumer, you may also submit a complaint through the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or applicable law. We will post the updated version on this page with a revised "Last updated" date and, where changes are material, notify you by email or through a notice on our platform. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
